The Canterbury Earthquake Recovery Act 2011

The Canterbury Earthquake Recovery Act 2011 came into force on 19 April 2011.

Changes to legislation have been made in response to the earthquake, including Orders made under the Canterbury Earthquake Recovery Act 2011, and Orders and Regulations made under the Canterbury Earthquake Response and Recovery Act 2010 and under other legislation.

Canterbury Earthquake (Social Security Act) Order (No 2) 2010 Amendment Order 2012

Purpose

The purpose of the Order in Council is to enable the Earthquake Commission (EQC) to carry out the managed repair of residential land and property in Canterbury, particularly through the Project Management Office established by the Commission. 

Effect

The Canterbury Earthquake (Earthquake Commission Act) Order 2012 exempts EQC from the requirement to settle reinstatement claims within one year after the amount of damage has been determined; and expressly allows EQC to invoice claimants for the excess so that EQC is not in breach of its statutory cap on liability.

Canterbury Earthquake (Social Security Act) Order (No 2) 2010 Amendment Order 2012

Purpose

The Order in Council extends the current Order which is due to expire on 31 March 2012.

Effect

The Canterbury Earthquake (Social Security Act) Order (No 2) 2010 Amendment Order 2012 proposes that the amendment to the definition of Accommodation Supplement be continued until 31 March 2014 to allow people to continue to receive financial assistance where necessary.

Canterbury Earthquake (Education Legislation) Order 2012

Purpose

The Order in Council amends education legislation under the Canterbury Earthquake Recovery Act 2011. It replaces the Canterbury Earthquake (Education Act) Order 2011 which expires on 1 April 2012.

Effect

The Order in Council will extend the effect of a number of provisions in the Canterbury Earthquake (Education Act) Order 2011 for another year, and proposes three new provisions that will help ensure a smoother recovery and renewal process.

Canterbury Earthquake (Inland Revenue Acts) Amendment Order 2012

Purpose

The Order in Council will extend the effect of the existing Canterbury Earthquake (Inland Revenue Acts) Order 2011 for a further six months under section 71 of the Canterbury Earthquake Recovery Act 2011.

Effect

The Order in Council will extend the deadlines for the Canterbury Regional Council to adopt a new regional public transport plan and a new Regional Land Transport Strategy. It will also make some changes to Canterbury’s existing regional passenger transport plan to accommodate the changed circumstances for bus services as a result of the earthquakes.

Canterbury Earthquake (Transport Legislation-Canterbury Regional Transport Planning) Order 2011

Purpose

The Canterbury earthquakes caused severe disruption to transport planning and public transport services. This made it difficult for the Canterbury Regional Council to meet some of its statutory planning obligations. The Order in Council will allow Canterbury Regional Council meet those statutory planning obligations.

Effect

The Order in Council will extend the deadlines for the Canterbury Regional Council to adopt a new regional public transport plan and a new Regional Land Transport Strategy. Canterbury Earthquake (Local Government Act 2002) Order (No 2) 2011.

Purpose

To provide councils with a workable long-term planning solution for local government in Christchurch that supports earthquake recovery.

Effect

The Order in Council will permit the four councils in greater Christchurch to defer the preparation of their long-term plans by one year and makes consequential modifications to the operation of the Local Government Act for any council that chooses to defer.

Canterbury Earthquake (Tax Administration Act) Order (No 2) 2011.

Purpose

The Order in Council replaces the Canterbury Earthquake (Tax Administration Act) Order 2011, which expires on 31 October 2011.

Effect

The Order in Council allows information sharing from Inland Revenue to other government agencies to enable those agencies to provide assistance to, or fulfil any obligation to earthquake affected communities, for another 12 months.

Purpose

The purpose of the Order is to repeal and replace the Canterbury Earthquake (Reserves Legislation) Order 2011, to extend the timeframe for powers provided to councils to permit reserves to be used for earthquake response and recovery efforts.

Effect

Extends the ability to use reserve land for response and recovery efforts past March 2012. Provides councils with the power to permit reserve land to be used for the placement of temporary accommodation and other earthquake response activities, such as the processing of demolition waste.

Purpose

The purpose of the draft Orders is to facilitate recovery by expediting Resource Management Act 1991 and Reserves Act processes for electricity network recovery works in Christchurch.

Effect

Resource consents from Christchurch City Council to authorise:
The construction of three temporary 66Kv lines between Bromley, Dallington and New Brighton.
The construction of a replacement for the damaged Pages Road substation at Rawhiti Domain
Distributing and operating diesel generators to minimise disruption to supply from repairs and supplement generation capacity.

Canterbury Earthquake (Building Act) Order 2011

Purpose

The purpose of the Order is to help councils to deal with ongoing earthquake response issues promptly and effectively.  It will also help to ensure that people in Canterbury are adequately protected from public health and safety risks following the Canterbury Earthquakes, and ensure that recovery activities are facilitated.

Effect

The Order in Council replaces the Canterbury Earthquake (Building Act) Order 2010, which expires on 16 September 2011, and provides councils with additional powers to deal with dangerous building situations and extends the period for which the powers are available to 16 September 2013.

Canterbury Earthquake (Resource Management Act—Burwood Resource Recovery Park) Order 2011

Purpose

The purpose of the Order is to permit the storage, sorting and processing (including recycling) of earthquake waste at the Burwood Resource Recovery Park through a modified resource consent process.

Effect

Provides for the activities at Burwood to be classified as controlled activities that must be approved by the Christchurch City Council and Environment Canterbury, with the councils being able to control how the environmental effects are managed through consent conditions

Provides for the councils seeking written comments from adversely affected parties within ten working days and considering comments received when making a decision on the applications.

Purpose

Relaxes or suspends specific Local Government Act provisions for Christchurch City Council that may divert resources away from recovery, or may not be reasonably capable of being complied with due to the circumstances resulting from the earthquakes.

Effect

Modifies Local Government Act 2002 provisions, in relation to the 2010/11 annual report and 2011/12 annual plan content and preparation processes for Christchurch City Council, and in relation to preparation of the 2011/12 statements of intent for council-controlled organisations.

Canterbury Earthquake (Energy Companies Act) Order 2011

Purpose

Modifies the application of the Energy Companies Act 1992 to Orion New Zealand so that it can benefit from extra time to prepare and update its statement of corporate intent and operations report, particularly in light of the changes to the electrical lines infrastructure since the earthquakes.

Effect

Defers the dates by which Orion New Zealand is required by the Energy Companies Act 1992 to deliver its 2011/12 statement of corporate intent (by three months), and 2010/11 operations report and financial statements (by two months).

Purpose

Consolidates the provisions of orders made under the Canterbury Earthquake Response and Recovery Act 2010, namely the Canterbury Earthquake (Historic Places Act) Order 2010 as amended by the Canterbury Earthquake (Historic Places Act) Amendment Order 2011

Effect

Continues the provisions under the 2010 Orders and adds a streamlined New Zealand Historic Places Trust process for determining applications to modify sites of interest to Maori in a way that balances the need to support the recovery and rebuilding ofCanterburyagainst the need to protect sites of interest to Maori.

Canterbury Earthquake (Resource Management Act Port of Lyttelton Recovery) Order 2011

Purpose

Provides for up to 10 ha of reclamation and port activities necessary for the recovery of the Port of Lyttelton to proceed without being unduly impeded by certain processes of the Resource Management Act 1991.

Effect

Specified stakeholders must be consulted before applications lodged. Activities classified as controlled and processed as non-notified resource consent applications within 5 working days by councils. No rights of appeal to the Environment Court, except on the part of the applicant. Enforcement action only able to be undertaken by councils.

Canterbury Earthquake (Transport Legislation) Amendment Order 2011

Purpose

Provides a means to permit the operation of heavy vehicles from Australia or Canada as part of the recovery effort.

Effect

Heavy vehicles registered in and imported from Australia and Canada can operate without the need to comply with distance licence requirements under the Road User Charges Act 1977 or the requirements of Accident Compensation (Motor Vehicle Account Levies) Regulations 2010.

Purpose

Extends the deadline for Christchurch taxi operator compliance with installing in-vehicle security systems in recognition of financial hardship and disruption caused by the earthquakes.

Effect

Christchurch taxi operators must comply with requirements relating to in-vehicle security camera systems and emergency alert and response facilities by 1 May 2012 instead of 1 August 2011.
